Terms & Conditions
for Performing at Teeyan Teej Deeyan 2014
1. Teeyan Society Incorporated of 3 Lombardo Street Prestons NSW, (“TS”) is the organiser and promoter of cultural event hosted at Bowman Hall, Blacktown, NSW, (the “Venue”) Teeyan Teej Deeyan on Sunday, 20 July 2014 (“TTD14”).
2. You (the “Applicant”) have voluntarily agreed to perform at TTD14 (the “Application”). For the avoidance of doubt, submission of an Application does not guarantee that the Applicant will be engaged to perform at TTD14. Applicants will only be engaged to perform at TTD14 following acceptance of the Application by TS in writing (which may be by email, sms or over the phone), which shall be at TS’s sole and absolute discretion. In these terms & conditions, the “Performer” means an Applicant whose Application has been accepted by TS.
3. These terms & conditions constitute a legally binding agreement between TTD14 and the Performer regarding the Performer’s performance at TTD14 and shall become effective on the date that the Applicant’s Application is accepted.
a. TS and the Performer agree that the Performer’s performance is voluntary and that TS shall not pay the Performer any monetary remuneration in relation to the Performer’s performance. However, the Performer may be presented with a participation certificate or trophy.
b. The Performer is not employed by TS.
5. The Performer’s Obligations
a. The Performer must fully co-operate with, and follow the instructions of, TTD14 organisers, participants, volunteers, helpers (and any staff working for Bowman Hall) at all times.
b. The Performer must arrive at the Venue and register their arrival with their nominated stage manager no later than 2 hours prior to the time of their performance.
c. The Performer must arrive at the backstage area and report back to their nominated stage manager no less than 45 minutes prior to the time of the Performer’s performance to ensure that all musical instruments are checked and tuned prior to going on stage.
d. TS reserves the right to change the time of or cancel the performance if the Performer fails to comply with clauses 5a, 5b and 5c, without any liability to the Performer.
e. The Performer is required to start their performance on time. If the Performer starts their performance late, TS reserves the right to stop the performance at the programmed finish time or to rearrange the time of the performance.
f. If the Performer is under 18 years of age at the date of TTD14, they must be accompanied at all times by an adult.
g. The Performer must comply with the joining instructions set out in the Schedule annexed to these terms & conditions and any other written instructions issued by TS.
h. The Performer will only be permitted to use electrical equipment which has been provided within Hall.
i. The Performer agrees to ensure that its performance and vocals are suitable for a family audience.
j. The Performer shall not harass, accost or interfere in any way with TS’s audience, guests, helpers and volunteers before, during or after the performance.
k. TS reserves the right to stop any performance which, in its sole opinion, is in breach of clauses 5i and 5j.
l. The Performer must not be under the influence of drugs or alcohol when performing.
6. TS’s Obligations and Liability
a. TS will assign a performance slot to the Performer and will use reasonable endeavours to maintain performance times. However, TS reserves the overall right to change the performance schedule or the location of the performance within the Venue, at any time and for any reason, without any liability to the Performer.
b. TS will use its reasonable endeavours to ensure that TTD14 goes ahead as planned but will bear no liability to the Performer for any loss whatsoever in the event that TTD14 is cancelled or postponed for whatever reason.
7. Health and Safety
a. The Performer is only permitted to take water in plastic bottles into the backstage and stage areas.
b. The Performer is prohibited from taking alcohol or drinks in glass bottles into the backstage or stage areas.
c. The Performer is prohibited from taking any food items into the backstage or stage areas.
d. Stage-diving or similar activities are strictly prohibited. If the Performer engages in any activities prohibited under this clause 7d, TS reserves the right to immediately stop the Performer’s performance and may terminate the Performer’s set.
e. TS reserves the right to stop a performance if, in its sole opinion, allowing the performance to continue could result in injury to any person or damage to any equipment supplied for the running of TTD14. In the event that the Performer causes any damage to equipment supplied by TS for TTD14, the Performer agrees to fully indemnify TS for any loss incurred.
f. TS reserves the right to eject the Performer from TTD14 and prohibit the Performer from performing at future events organised by TS, or any of its group companies, in the event of a breach of any of clauses 7b to 7e.
8. Intellectual Property
a. TS may engage a photographer or photographers (the "Photographer/s") to photograph and or film TTD14 and a radio station operator (the "Broadcaster") to broadcast TTD14 performances live.
b. By participating in TTD14, the Performer consents to TS's use of any images and footage of the Performer captured by the Photographer/s at TTD14 for TS's promotional purposes and acknowledges that copyright in such images and/or footage shall vest in TS.
c. By participating in TTD14, the Performer consents to TS's use of any images and footage of the Performer captured by the Photographer/s at TTD14 for TS's promotional purposes on Face Book and YouTube and acknowledges that copyright in such images and/or footage shall vest in TS.
a. TS has its own public liability insurance. However, TS urges the Performer to consider taking out its own suitable public liability insurance policy.
b. The Performer brings equipment and personal possessions to TTD14 at its own risk. TS cannot be held responsible for any theft, losses or damage to any equipment or personal possessions brought onto the TTD14 site at any time before, during or after TTD14.
c. TS will not provide refreshments or coupons for refreshments to the performers during the event. However water can be supplied on request.
d. By submitting the Application, the Performer agrees to accept these terms & conditions.
1. The Performer will be notified in advance of the Performer’s exact set time and the stage the Performer will be invited to play at the Venue. The Performer is required to follow the instructions below.
2. Access to TTD14
a. TTD14 is to be held at the Venue, which is Bowman Hall, Blacktown, NSW.
b. The Performer will make own arrangement to reach the venue and back.
3. Performance Arrangements
a. The Performer must arrive at the Venue no less than 2 hours prior to their set time. The Performer must report to their nominated stage manager to confirm arrival. Equipment should be unloaded as quickly and as efficiently as possible.
b. The Performer must report back to their nominated stage manager at least 45 minutes prior to their set time to ensure that all instruments are checked and tuned.
